Nolan v. Account Control Technology, Inc.
Filed: December 19, 2017 ◆§ 1:17cv1184
Account Control Technology, Inc. is on the receiving end of a proposed class action lawsuit alleging it falsely implied to a consumer that the amount of her debt was increasing.
Texas
Account Control Technology, Inc. is on the receiving end of a proposed class action lawsuit alleging it falsely implied to a consumer that the amount of her debt was increasing. The plaintiff in the case says she received a collection letter from the defendant that stated the balance of a loan she allegedly owed to Capella University but informed her that the amount owed at a later date “may be greater” than the amount listed due to interest, late fees, and other charges. The suit argues that the loan was not, in fact, subject to any of these additional charges and would never change.
“[The defendant] is aware that during the collection of this debt the balance will not vary at all,” the complaint reads, “and stating that it may increase is merely a deceptive collection tactic to influence the consumer to pay the debt immediately without disputing it.”
