Subaru Fuel Pump Settlement Ends Lawsuit; Eligible Drivers Can File a Claim Form for Benefits

Subaru faces a class action that claims certain vehicle models can unexpectedly stall and shut down due being equipped with a defective low-pressure fuel pump.
Subaru has agreed to settle a proposed class action lawsuit that claimed certain vehicle models are equipped with defective Denso low-pressure fuel pumps, which can cause an engine to unexpectedly lose power and stall.

The deal received preliminary approval from the court on July 11, 2024 and covers an estimated 2.3 million people in the United States or its territories who owned or leased certain Subaru vehicles equipped with low-pressure fuel pumps supplied by Denso and its affiliates.
This includes certain 2018-2020 Subaru Impreza, Outback, Legacy, Forester, Ascent, BRZ, and WRX vehicles covered by the automaker’s 2020 and 2021 fuel pump recalls, as well as certain 2017-2020 Subaru Impreza, Outback, Legacy, Forester, Ascent, Crosstrek, BRZ and WRX vehicles.

To find out if your vehicle is included in the Subaru fuel pump settlement, enter your vehicle identification number on the settlement site’s VIN Lookup page.
A safety notice on the settlement site urges owners and lessees of the recalled Subaru vehicles to complete the recall repairs as soon as possible, if they have not already done so, at any authorized U.S. Subaru dealer.
According to the site, the settlement offers several benefits, depending on the vehicle model.

Subaru has agreed to extend the warranty coverage for fuel pumps replaced on recalled vehicles for 15 years, measured from the date of replacement of the fuel pump, and up to 150,000 miles, whichever comes first.
Subaru will offer class members who still own or lease a covered vehicle not included in the recalls a customer support program that will provide prospective coverage of 15 years for repairs needed to correct defects, if any, in materials or workmanship in original equipment fuel pumps. In addition, Subaru dealers will provide a loaner or rental vehicle to class members at no cost and upon request when a driver’s fuel pump is being replaced pursuant to the customer support program. This category of covered drivers will also be entitled to a complimentary tow to the nearest Subaru dealer if their vehicle is inoperable or exhibits a dangerous condition.
Consumers covered by the settlement do not need to do anything to be eligible for coverage under the extended replacement parts limited warranty or customer support program.
Also as part of the settlement, any class member who files a valid, timely claim with supporting documentation can receive reimbursement for certain out-of-pocket expenses they incurred to repair or replace a Subaru fuel pump.
Finally, class members who are denied coverage for repairs under the customer support program or extended replacement parts limited warranty can take their covered vehicle to a second Subaru dealer for an independent determination.
“If the second Subaru Dealer determines that the Covered Vehicle qualifies for repair under the Customer Support Program or the Extended Replacement Parts Limited Warranty, the Class Member shall be provided those benefits as provided in the Settlement Agreement,” the site says.
A final approval hearing is scheduled for November 18, 2024. It is typically after a settlement receives final approval from the court, and any appeals or objections have been resolved, that class members will begin to receive benefits.
