A Wisconsin consumer alleges in a proposed class action that law firm Stupar, Schuster & Bartell, S.C. violated federal collection laws when it sent a notice in which it threatened legal action against the plaintiff to collect on the balance owed. The lawsuit claims an unsophisticated consumer would wrongly believe, based on the defendant’s alleged conduct in the notice, that a law firm had been hired to sue him or her, with an attorney professionally involved in collecting on the consumer’s debt.
“Upon information and belief, [the defendant] would not, in the regular course of business, file an action against [the plaintiff] over $158.93,” the case argues.
