The 10-page Navient lawsuit was filed by a woman who alleges the student loan servicer has repeatedly and illegally placed debt collection calls to her cell phone, including while she was at work. According to the suit, the company’s conduct has violated the Telephone Consumer Protection Act, a federal law that prohibits placing non-emergency calls using an artificial or prerecorded voice without first obtaining the recipient's authorization.
The plaintiff contends that the alleged robocalls, which were placed in connection with multiple student loans she’d previously taken out, were “highly disruptive and distracting.”
Per the case, the woman answered one call from Navient in April 2024 and requested that it stop contacting her cell phone, explaining that her employer would reprimand her if she continued to receive calls at work.
Nevertheless, the company placed “no less than a dozen” more robocalls to the plaintiff’s cell phone after the woman requested that the calls cease, the complaint asserts.
The filing says Navient also left prerecorded voicemails when the plaintiff left calls unanswered.
The woman claims Navient’s “abusive” collection practices were a nuisance and invaded her privacy.
The Navient robocall lawsuit looks to represent anyone in the United States who, in the past four years, received a prerecorded call on their cell phone from the company or a third party acting on its behalf and has not previously consented to being contacted by the defendant.
