Stuart Weitzman, LLC; Stuart Weitzman Retail Stores, LLC; and Stuart Weitzman Holdings, LLC are facing a proposed class action alleging the defendants conducted illegal background checks on prospective employees. The suit takes issue with the disclosures and authorization forms provided to each candidate, noting that under federal law, background check disclosures must be presented on a standalone form. According to the complaint, the defendants’ forms were “embedded with extraneous information,” including a liability release, and were not “clear and unambiguous.”
The case further alleges that the defendants failed to provide applicants with notice of their rights under the Fair Credit Reporting Act, such as their right to dispute any information found in their report and obtain credit scores. The plaintiff also argues that he was not informed of his ability to request “a complete and accurate disclosure of the nature and scope of the investigation,” as provided by the FCRA.
The suit claims that as a result of these alleged failures, the defendants never obtained proper authorization to perform background checks on prospective employees and that the reports were therefore illegal under federal law.
