Koenig v. Stevens Business Services, Inc.
Filed: August 24, 2018 ◆§ 1:18cv4820
Stevens Business Services, Inc. is facing a lawsuit over an allegedly unlawful debt collection notice that failed to clearly state a consumer's debt balance.
New York
Stevens Business Services, Inc. is facing a proposed class action over claims that it sent a New York consumer an unlawful debt collection notice that failed to clearly state the individual’s debt balance.
According to the lawsuit, the plaintiff received a letter from the defendant in January 2018 regarding a debt owed to gas company Keyspan New York. The allegedly deceptive letter violated the Fair Debt Collection Practices Act (FDCPA) by failing to disclose that the consumer’s debt balance may increase due to late fees, the complaint says. Moreover, the suit alleges the notice failed to adequately explain whether late fees were accruing on the obligation, as well as break down what parts of the debt amount are attributable to principal and any other fees. As such, the case argues that the notice unlawfully failed to clearly convey the amount of debt.
