Stephen Einstein & Associates, P.C. is on the receiving end of a proposed class action filed by a New York woman who claims the debt collector misled her regarding the amount of her alleged debt.

Stephen Einstein & Associates, P.C. is on the receiving end of a proposed class action lawsuit filed by a New York woman who claims the debt collector misled her regarding the amount of her alleged debt. The plaintiff says the defendant sent her a collection letter that stated a “current balance” of $6,694.29 without mentioning whether the account would increase due to interest.
“Plaintiff’s account was not subject to the accrual of interest,” the complaint explains, “but by stating a ‘Current Balance,’ Defendant falsely suggested that immediate payment of the balance would benefit Plaintiff by implying that the Balance would be subject to change, and could be subject to additional interest.”
Alternatively, the suit suggests, if the plaintiff’s account were, in fact, accruing interest, the defendant still violated federal law by failing to disclose that the balance would change.
