Stanley Travel Mug Recall Lawsuit Filed Against Pacific Market International Over Lid Defect, Burn Risk

The 21-page Stanley lawsuit was filed after the United States Consumer Product Safety Commission (CPSC) and defendant Pacific Market International (PMI) announced a recall last month of millions of Stanley travel mugs, including the stainless steel Stanley Switchback and Trigger Action models in all cup sizes.
According to the CPSC’s December 12 announcement, the travel mugs were recalled because of an apparent manufacturing flaw in the product’s lid threads, which can shrink when exposed to heat and torque. This can cause the lid to loosen and leak or detach completely during use, posing a burn risk, the CPSC reports.
As of the recall announcement, at least 38 burn injuries and 91 instances of the lid detaching during use had been reported, the CPSC says.
The lawsuit against PMI alleges the company concealed that its purportedly “leakproof” travel mugs were defective and posed a safety hazard. The suit contends that PMI only briefly publicized the recall and has since “tucked away” the link to the CPSC announcement on a remote part of its website that “few people are likely to see.”
In addition, the case says the company has failed to adequately compensate consumers in the wake of the recall. Customers who seek recourse are offered only a replacement lid, and “[a]ny requests for refunds are denied,” the complaint claims.
“By design, the recall received very little publication, with the result that the response rate has been low,” the filing states. “An offer to replace travel mug lids does little good when Stanley did the bare minimum possible to let people know about the offer.”
As such, the company has been able to minimize the cost and burden of the recall and protect its bottom line, the class action suit asserts.
The lawsuit looks to represent anyone in the United States who purchased a travel mug subject to the Stanley recall.
