A proposed class action against Southwest Credit Systems, L.P. claims the company violated the Fair Debt Collection Practices Act (FDCPA) by failing to explain what “equipment costs” were in the plaintiff’s collection letter regarding a debt owed to Time Warner Cable. The equipment cost was listed as $0.00, but the lawsuit argues that “the letter implies that there could be some unknown charges added to the debt in future letters.” The unsophisticated consumer, the complaint continues, could interpret the aforementioned zero equipment charge as “representations that the debt collector has a right to add charges to the alleged debt,” especially since the plaintiff reportedly never received equipment from Time Warner Cable.
