Southwest Collection Services Facing Lawsuit Over ‘Threatening, Coercive’ Language in Notice

A consumer claims Southwest Collection Services mailed her a collection notice intended to scare her into making payment on her debt.

The plaintiff in a proposed class action against Southwest Collection Services, LLC alleges the company mailed her a collection notice in which it included threatening and coercive language intended to scare her into making payment. According to the lawsuit, the defendant’s letter to the plaintiff read, in part:
“This letter constitutes formal demand upon you to make payment in full of the balance due within fifteen (15) days of the date you receive this letter. If payment is not made within the time period specified, we will consider legal proceedings to enforce collection.”
The complaint points out that although the defendant sent the notice in question around February 3, 2017, more than one year has passed without Southwest Collection Services bringing any legal action against the plaintiff over her account.
