A class action has been filed against the operators of two Southern Hospitality BBQ sports bar and southern-style restaurants in New York City.
A class action has been filed against the operators of two Southern Hospitality BBQ sports bar and southern-style restaurants in New York City by a former cook who claims he was stiffed out of overtime pay. Filed against 42-15 235th Street Hospitality LLC and SHNY Restaurant Group LLC, the nearly 20-page complaint also alleges the restaurant operators failed to maintain accurate pay records and pay “spread of hours” wages for days in which the plaintiff had to work more than 10 hours. Under New York state labor laws, employees are owed “spread of hours” pay—an extra hour’s worth of pay at the minimum wage regardless of their regular pay rate—for each work day in which a shift goes longer than 10 hours.
