Jobs and Main Realty Co. and a John Doe defendant are wrapped up in a proposed class action filed over alleged structural violations of the Americans with Disabilities Act (ADA) at a Southampton, New York Chico’s retail location. The plaintiff, who the lawsuit says has multiple sclerosis and relies on a wheelchair, claims he attempted to enter the defendants’ facility—a “place of public accommodation”—sometime in 2017 but was unable to due to an “unlawful architectural barrier.” Although accessibility modifications to the defendants’ facility are “readily available,” the lawsuit claims, the companies’ alleged failure to comply with the ADA amounts to discriminatory conduct that’s denied the plaintiff the same accommodations available to able-bodied consumers.
