South Carolina Couple Files Class Action Against Hyundai for Allegedly Declining Warranty Coverage for Engine Replacement

Two plaintiffs have filed a proposed class action suit over Hyundai's alleged failure to cover repairs to their vehicle that supposedly suffered from an engine defect.
A proposed class action lawsuit filed in South Carolina details allegations from two named plaintiffs who claim Hyundai Motor America and Hyundai Motor Company illegally failed to provide warranty-covered repairs to their 2015 Sonata that suffered from engine and transmission defects.
The plaintiffs, who co-own the vehicle at the center of the case, argue that because their Sonata was within its five-year/60,000 mile new vehicle limited warranty, Hyundai breached its express warranty by failing to cover repairs necessary as the result of engine defects. According to the lawsuit, which runs through a long repair history for the plaintiffs’ vehicle that ultimately culminated in recommendations for both an engine and transmission replacement, Hyundai sold to the public vehicles that “were not in merchantable condition, were not fit for the ordinary purpose for which cars are used, and/or were not of the same quality as those generally acceptable in the trade.” Further, the plaintiffs charge that they took “reasonable steps” to notify the defendants of the alleged warranty breach prior to filing this lawsuit, and that Hyundai “knew of the defect and have [sic] chosen to conceal it.”
