Sonic Hit with Second Class Action Following Point-of-Sale Data Breach

Ramirez v. Sonic Corp.
Filed: September 29, 2017 ◆§ 5:17-cv-01044-F
Another consumer has sued Sonic over how it handled a data breach of its payment systems that exposed around five million payment account numbers.
A second proposed class action has been filed against Sonic Corp. in the wake of a data breach of the drive-in restaurant chain’s payment systems that reportedly exposed up to five million credit and debit card account numbers. Filed in Oklahoma, the 35-page complaint alleges Sonic ignored the rights of proposed class members by failing to take adequate, reasonable security measures to ensure its data systems were secure, and, despite the prevalence of such breaches in recent years, particularly with fast food restaurants, further erred by failing to monitor and notice the hack in a timely fashion.
“Sonic had the resources to prevent a breach, but neglected to timely and adequately invest in data security, despite the growing number of well-publicized data breaches,” the lawsuit laments. “Had Sonic remedied the deficiencies in its data security systems, followed security guidelines, and adopted security measures recommended by experts in the field, Sonic would have prevented the data breach and, ultimately, the theft of its customers’ [personally identifiable information].”
