The drive-in fast food chain is facing a lawsuit over its alleged failure to protect customer payment information filed roughly a day after announcing the hack.
Almost immediately following its September 26 announcement of a payment system data breach in which up to five million credit and debit card account numbers had been compromised, Sonic Corp., which operates more than 3,500 drive-in restaurants nationwide, finds itself facing a proposed class action lawsuit. Filed in Oklahoma, the lawsuit aims to take Sonic to task for its alleged failure to keep safe consumers’ personally identifiable information. The plaintiff argues Sonic, having seen similar breaches occur at other fast food restaurants, could have prevented the hack, yet failed to take adequate steps to ensure its data systems were protected.
The complaint alleges the payment system utilized by the defendant was more than 30 years old, a fact the case says should have made Sonic well-aware that information stored in its payment systems was susceptible to theft.
