Sonic Drive-In Hit with Class Action in Oklahoma Over Alleged Spam Texts

A class action alleges Sonic has sent unsolicited text messages to consumers without obtaining prior express written consent to do so.
A Cook County, Illinois consumer alleges Sonic Drive-In continued to send her unsolicited, automatically generated marketing text messages after she replied “stop” to opt out of further communications with the fast food chain.
The 13-page proposed class action alleges defendant Sonic Corp. has violated the federal Telephone Consumer Protection Act (TCPA) by sending unsolicited, automatically generated promotional text messages to consumers without obtaining prior written consent to do so.
Per the case, Sonic’s conduct has “resulted in the invasion of privacy, harassment, aggravation, and disruption of the daily life of thousands of individuals.”
According to the lawsuit, the plaintiff received in July 2020 at least two text messages from Sonic in which the restaurant touted the return of the BBLT (bacon, bacon, lettuce, tomato) sandwich. Though the woman replied “stop,” Sonic “ignored Plaintiff’s opt-out demand” and sent another text message days later, the case claims.
The complaint alleges Sonic “does not record any request from a telephone subscriber not to receiver texts” or place their name on an internal do-not-call list.
The lawsuit says the unsolicited texts sent by Sonic wasted roughly 10 minutes of the plaintiff’s time to review the messages.
