Daniels v. Solomon and Solomon P.C. et al
Filed: February 13, 2017 ◆§ 2:17-cv-00757-RBS
A Pennsylvania woman has filed a proposed class action that claims defendant Solomon and Solomon P.C. violated the Fair Debt Collection Practices Act.
Pennsylvania
A Pennsylvania woman has filed a proposed class action that claims defendant Solomon and Solomon P.C. violated federal law by attempting to collect a debt in a state where it had no jurisdiction. According to the 17-page complaint, neither Solomon and Solomon P.C. nor its attorneys are licensed to practice law in Pennsylvania, yet the collection notice the plaintiff received include language stating: “Please be advised that your account with Solomon and Solomon P.C. still remains unpaid, and has been reported to the national credit bureaus.”
The lawsuit claims the defendant’s use of the above language in a collection notice would confuse the least sophisticated consumer as to whether the defendant was “meaningfully involved” in the matter.
