The 16-page Snapchat lawsuit alleges that the platform ran afoul of the Telephone Consumer Protection Act (TCPA)—a federal law that aims to protect individuals from unsolicited telemarketing communications—when it repeatedly sent text messages to the plaintiff, an Oregon resident who registered his phone number on the do-not-call list in October 2023.
According to the class action suit, the plaintiff has never created a Snapchat account and at no point authorized the company to contact him. Nevertheless, the man claims Snapchat has sent him at least 14 texts promoting its platform and has likely sent similar unwanted messages to thousands of other Oregon residents.
The case charges that Snapchat’s “widespread and abusive telemarketing practices” contravene the TCPA, which explicitly prohibits companies from contacting phone numbers on the National Do Not Call Registry.
Indeed, the defendant has “ignored” the National Do Not Call Registry and “spammed” the plaintiff and other consumers in an effort to grow its user base and bolster profits, the Snapchat lawsuit contends.
The suit looks to represent anyone in the United States who does not have a Snapchat account and, at any time in the last four years, received more than one text message on their cell phone from the company within any 12-month period after their phone number was listed on the National Do Not Call Registry.
