A proposed class action filed in September 2017 alleging Fruit Bliss slack-fills packages of its products has been moved from California to New York.
A proposed class action lawsuit filed in September 2017 against Penguin Trading, Inc., which does business as Fruit Bliss, has been transferred from the U.S. District Court for the Central District of California to the Eastern District of New York.
The plaintiff alleges packages of the defendant’s organic fruit products unlawfully contain roughly 50 percent empty space, called slack fill. Moreover, the man claims nearly 80 percent of a package of Fruit Bliss Organic Deglet Nour Dates he purchased last year was non-functional slack fill. The case charges Fruit Bliss intentionally slack fills packages of its products to mislead consumers.
The proposed class named by the lawsuit includes all California residents who bought Fruit Bliss Organic products with allegedly non-functional slack fill.
