Sirius XM Facing Robocall Class Action in California

Per a lawsuit, Sirius XM Radio allegedly robocalled two plaintiffs after they purchased a vehicle that came with a free three-month trial of the service.
Sirius XM Radio Inc. is the defendant in a proposed class action filed in California that claims the company unlawfully used an automatic dialing system to place calls to consumers’ cell phones without consent. Citing possible Telephone Consumer Protection Act (TCPA) abuses, the husband and wife plaintiffs claim the calls began around July 2016 after they purchased a vehicle that came with a free three-month trial of Sirius XM. The case says the calls were placed in an effort to persuade one of the plaintiffs to pay to extend the satellite radio service upon the free trial’s expiration. According to the plaintiffs, Sirius called them again numerous times in October and November 2016 even after being ordered to stop.
