Rivera v. Jhb Companies Llc et al
Filed: May 17, 2019 ◆§ 2:19cv4311
A lawsuit claims that Singles Swag renewed California customers’ accounts without first advising them of its terms of service and cancellation policy.
California
A proposed class action alleges that the operating company behind subscription service Singles Swag automatically renewed California customers’ accounts without first advising them of its terms of service and cancellation policy as required by state law.
The Florida-based defendant offers subscriptions for boxes of beauty products, fashion accessories, and other items, according to the lawsuit. Citing the California Business Professions Code, the case claims the company failed to clearly and conspicuously state within its checkout webpage and follow-up emails its automatic renewal terms and cancelation instructions. Without obtaining consumers’ informed and explicit consent for ongoing service, companies are not authorized to make automatic charges to their accounts, the suit says.
