In a proposed class action over alleged Fair Debt Collection Practices Act (FDCPA) violations, a Florida man claims defendant Simm Associates, Inc., in a demand letter, “falsely and misleadingly” misidentified the name of the creditor to whom the debt was owed. The complaint claims the defendant failed to list any other current creditor other than “PayPal Credit,” which is the brand of an account issued by Comenity Capital Bank, the actual creditor to whom the plaintiff’s debt is owed.
