The 12-page Siemens lawsuit alleges that the industrial manufacturing and tech conglomerate has breached Washington’s Equal Pay and Opportunities Act (EPOA), whose pay transparency provision requires employers of a certain size in the state to include in every job posting the wage scale, salary range and description of all benefits and other compensation a hired applicant will be given.
The plaintiff, a Washington resident, says he applied for a position with Siemens in November 2023, expecting to learn the job’s pay rate at some point as he advanced through the application.
“However, [the defendants] withheld the rate of pay for the open position in the job posting and throughout the application process, forcing [the plaintiff] to complete the entire application without learning the rate of pay,” the suit describes.
The case claims Siemens did not disclose the offered wage scale or salary range in the posting, as required by law, rendering the plaintiff unable to evaluate the job’s pay details and compare them to other open positions in the job market.
According to the complaint, compliance with the EPOA’s pay transparency provision is crucial to combatting the “pervasive” pay gap in Washington with respect to women and other protected classes. The filing asserts that this provision helps facilitate a discussion at the beginning of the hiring process instead of after an offer has been made, which serves to support an applicant’s ability to negotiate pay.
As such, the plaintiff alleges that Siemens has engaged in discriminatory hiring practices and contributed to wage inequality by refusing to comply with Washington’s EPOA.
The Siemens job posting lawsuit looks to represent anyone who, since January 1, 2023, applied for a job opening in the state of Washington with the defendants, and the job posting did not disclose a wage scale or salary range.
