A class action lawsuit filed today claims that Shield Screen, LLC and Tulsa's Green County Staffing LLC violated the Fair Credit Reporting Act (FCRA).
A class action lawsuit filed today claims that Shield Screen, LLC and Tulsa’s Green County Staffing LLC violated the Fair Credit Reporting Act (FCRA) with their allegedly unlawful background check disclosure practices. Tulsa’s Green Country, a staffing agency, and Shield Screen, a background check and consumer credit reporting agency, are alleged to have failed to provide the plaintiff with a federally mandated copy of his background check and summary of his rights FCRA rights “before taking adverse action against him.”
According to the lawsuit, Shield Screen did not provide the plaintiff and other class members with a notice saying it was furnishing a potentially adverse employment-purposed consumer report. “This important requirement,” the suit says, “is intended to provide consumers immediate notice of the furnishing of an employment report and details necessary to preemptively correct inaccuracies” in the report that may hurt any chances of employment. The plaintiff claims his report contained inaccuracies with regard to a felony conviction that had actually been reduced to a misdemeanor.
Court documents cite the precedent-setting Spokeo decision and how its ruling provides standing for the plaintiff’s claims, noting that he suffered actual “concrete and particularized” injury by being denied access to information to which he was entitled to by law. “[The plaintiff] further suffered an actual or imminent concrete and particularized injury,” the suit explains, “in that Green Country Staffing failed to provide him with his background report or a meaningful opportunity to dispute the report before its denied him employment based on the report’s contents.”
