A proposed class action claims Sentry Credit misrepresented that a consumer’s debt had been accelerated and overshadowed the woman’s debt dispute rights.
A proposed class action filed against Sentry Credit Inc. claims the debt collector misrepresented that a consumer’s debt had been accelerated and overshadowed the woman’s debt dispute rights.
According to the suit, the plaintiff received an account statement in July 2018 regarding a Nordstrom-branded TD Bank credit card that listed a “New Balance” of $10,314.07 and a “Minimum Payment Due” of $2,254.00. The following month, the case continues, the defendant mailed the woman a collection notice referring to the same debt that supposedly listed the total balance without indicating that only a portion of the debt—the “Minimum Payment Due”—was immediately owed as of that month. The complaint charges the notice, therefore, falsely represented “that the debt had been accelerated and the full balance was due,” at the time of the letter.
The case further claims the defendant overshadowed the plaintiff’s rights when it offered a settlement option before stating, “Call today for flexible repayment terms.” Directing the woman to call for payment terms “confuses the debt validation notice and encourages the consumer to forego her verification rights by communicating disputes about what portion of the balance was actually due orally rather than in writing,” the lawsuit argues.
