A proposed class action has been filed against Sentry Credit, Inc. over an allegedly misleading collection letter it sent to a New York consumer.
A proposed class action has been filed against Sentry Credit, Inc. over an allegedly misleading collection letter it sent to a New York consumer. The letter supposedly stated the plaintiff’s “total now due,” but failed to explain whether the amount was increasing due to interest. The suit argues that the defendant’s language implied that the balance could be accruing interest and that the plaintiff “would benefit” by paying it immediately. In reality, the complaint suggests, the plaintiff’s account was not subject to interest and the defendant’s representations were false. Even if the amount on the account was increasing, the case continues, the defendant would have still violated federal law by failing to disclose this fact in the letter.
