A proposed class action filed in Florida claims defendant SendingIO, Inc., which does business as video messaging app Cake, violated federal law by engaging in “intrusive telemarketing” to promote its product. Citing alleged Telephone Consumer Protection Act (TCPA) abuses, the case argues SendingIO deceives individuals who use its app into granting access to their contact lists, and, from there, uses an automatic telephone dialing system to transmit generic telemarketing text messages to the individuals’ contacts from “spoofed” phone numbers without consent. The lawsuit seeks injunctive relief and statutory damages.
