Select Portfolio Servicing is the defendant in a lawsuit that claims it refused to send the plaintiff information he requested pertaining to one of two mortgage loans.
Select Portfolio Servicing, Inc. (SPS) is the defendant in a proposed class action that claims it refused to send the plaintiff information he requested pertaining to one of two mortgage loans. According to the complaint, instead of sending the plaintiff the information he requested, the defendant sent the following:
“Due to the current litigation, SPS believes that it would be more appropriate to refrain from providing a detailed response to you at this time … and consider this matter closed.”
The defendant’s response to the plaintiff’s information request constitutes a violation of the Real Estate Settlement Procedures Act (RESPA), the complaint claims. Further, the plaintiff alleges the defendant has refused to send him requested information on at least four other occasions.
