A lawsuit has been filed on behalf of New York residents who received notices from Security Credit Systems, Inc. regarding a debt owed to School of Dental Medicine within the past year. According to the lawsuit, the defendant – Security Credit Systems Inc. – violated federal debt collection law by using “false, deceptive or misleading representations” and “unfair or unconscionable” means to collect debts. The suit claims the debt collector sent letters to at least 40 people in New York that listed a 2.5% processing fee for credit card payments and that this could confuse the least sophisticated consumer – specifically, as to whether the fee was authorized by law or by an agreement with the original creditor. Furthermore, the suit claims the letter’s form, layout and language could be confusing to the least sophisticated consumer.
