Two individuals with mobility disabilities are the plaintiffs in a proposed class action that claims Sears Holdings Corporation, Sears, Roebuck & Company and Kmart Holding Company systematically violate the Americans with Disabilities Act (ADA). The wheelchair bound plaintiffs, who one whom suffers from Spina Bifida, claim they and proposed class members were unlawfully “denied full and equal access” to the defendants’ facilities due to inaccessible parking lots and paths of travel.
Filed in Pennsylvania, the lawsuit alleges the plaintiffs experienced an unnecessary level of difficulty at Pittsburgh property owned by the defendants that included “excessive slopes” in supposedly accessible parking spaces. Further, the case notes investigators working for the plaintiffs reportedly examined multiple defendant-owned locations throughout Pennsylvania, Ohio and Colorado and found ostensible ADA-compliance issues at each location, including improperly sloped, and a lack of “van accessible,” parking spaces.
