The 17-page case alleges the Massachusetts-based company misleadingly markets that BioHeat Plus is “friendly to the environment, promotes better air quality and produces fewer harmful emissions.” In reality, the lawsuit contends, BioHeat Plus offers no more environmental advantages than standard home heating fuel.
Scott Energy also advertises that BioHeat Plus “burns cleaner,” as the heating oil is purportedly made from locally sourced waste products like cooking oil, plant and other renewable biodiesel sources and “ultra-low sulfur heating oil,” the complaint relays. According to the suit, none of these representations are true.
Per the BioHeat Plus lawsuit, the defendant also deceptively claims the fuel extends the lifespan of customers’ heating equipment and helps their systems run with fewer breakdowns.
Ultimately, the filing says, “Scott made a material, knowing, and/or willful misrepresentation[] that BioHeat Plus was a cleaner, better fuel” to the financial detriment of consumers.
The lawsuit looks to represent anyone in Massachusetts who purchased what was advertised as Scott Energy Company’s BioHeat Plus during the applicable statute of limitations period.
