The law firm behind a proposed class action against Insel Air over its alleged practice of charging passengers undisclosed 'exit fees' has filed another case in Florida.
The law firm behind a proposed class action against Insel Air over its alleged practice of charging passengers undisclosed “exit fees” has filed another case in Florida, this time against Santa Barbara Airlines, C.A. The suit’s three lead plaintiffs claim the defendant, which does business as SBA Airlines, breaches its contracts with passengers by charging flyers $80 “exit fees” that are not disclosed at the time consumers initially purchase their plane tickets.
“Despite the clear terms of its contract and the full payment of the tickets, the airline conducted a program in which its ticket-holding travelers were required to pay additional, extra-contractual Exit Fees at their sole U.S. departure airport, Miami International Airport, before being allowed to board their flights,” the 31-page complaint claims. “The airline already had the undisclosed Exit Fee program in place at the time the airline entered into a contractual agreement with its passengers.”
As with the previous lawsuit over exit fees, this latest case alleges only passengers flying from Miami to Venezuela were subject to the defendant’s extra-contractual conduct.
