The 13-page lawsuit claims that SAP, a super political action committee (PAC), engaged in an “intrusive” and unsolicited text message campaign to promote candidate Blake Masters during the 2022 Arizona Senate race. According to the case, SAP has violated the Telephone Consumer Protection Act by using an artificial or prerecorded voice to contact consumers’ cell phone numbers without first obtaining permission to do so.
The plaintiff, an Arizona resident, says she received two robotexts from SAP on November 7 and 8 last year that included video files that were automatically downloaded to her phone and contained an artificial or prerecorded voice. The phone numbers that sent the text messages constantly play a busy signal when called, the case adds.
Per the suit, the woman has no relationship with SAP and never provided the group with her phone number. The complaint alleges that other Arizona residents had experiences similar to the plaintiff’s, as the super PAC sent out its text messages “en masse without variation.”
“Defendant’s unsolicited texts caused [the plaintiff] actual harm, including invasion of her privacy, aggravation, annoyance, intrusion on seclusion, trespass, and conversion,” the filing states. “Defendant’s text messages also inconvenienced [the plaintiff] and caused disruption to her daily life.”
The lawsuit seeks to cover anyone in the United States who, within the past four years, was sent a text message from Saving Arizona PAC or anyone on its behalf that included an artificial or prerecorded voice in a video without their prior express consent.
