The companies behind SarabethsRestarants.com are the defendants in a class action citing alleged Americans with Disabilities Act violations.
The companies behind SarabethsRestaurants.com are the defendants in a proposed class action claiming the website does not abide by Americans with Disabilities Act (ADA) regulations and therefore discriminates against blind and visually impaired users. The 28-page complaint, filed in New York against Sarabeth’s Holding, Inc., Sarabeth’s at the Chelsea Market Ltd., Sarabeth’s Bakery Ltd., Sarabeth’s Tribeca, LLC, Sarabeth’s Pas LLC and Sarabeth’s Kitchen, LLC, alleges the companies’ website, though “heavily integrated” with their physical stores, contains access barriers that prevent ADA-protected individuals from fully enjoying the goods and services contained therein. From the lawsuit:
“These access barriers on [the defendants’] website have deterred [the plaintiff] from visiting [Sarabeth’s] physical restaurant locations, and enjoying them equal to sighted individuals because: [the plaintiff] was unable to find the location and hours of operation of [defendants’] physical restaurants on its website, preventing [the plaintiff] from visiting the locations to purchase items, and to view the items. [The plaintiff] intends to visit [the defendants’] restaurants in the near future if he could access their website.”
