Delux Cab, LLC v. Uber Technologies, Inc. et al
Filed: December 19, 2016 ◆§ 3:16-cv-03057-CAB-JMA
California taxicab company Delux Cab, LLC has filed a proposed class action against Uber Technologies, Inc., Uber USA, LLC, Rasier, LLC and Rasier-CA, LLC.
California taxicab company Delux Cab, LLC has filed a proposed class action against Uber Technologies, Inc., Uber USA, LLC, Rasier, LLC and Rasier-CA, LLC alleging the companies, in a campaign promoting the safety of riding with Uber, disparaged the safety of conventional taxi services. According to the plaintiff, Uber’s promotional claims of offering “the safest ride”—claims the lawsuit says are not backed by empirical data—have caused irreparable damage to the plaintiff and similar cab companies.
The plaintiff’s allegations are rooted in both Uber’s critical attacks on taxi companies and its practice of allegedly inducing riders to use its service by boasting “industry leading” background check standards – claims the lawsuit argues are false and not backed by any substantial data.
The proposed class covers all persons or entities licensed or permitted to operate taxicab services in San Diego, California within the last four years.
