A proposed class action has been added to the growing list of lawsuits filed against Samsung Electronics America, Inc. in response to its allegedly defective devices.
A proposed class action out of Pennsylvania has been added to the growing list of lawsuits filed against Samsung Electronics America, Inc. in response to its allegedly defective devices. This suit claims Samsung issued a recall in September 2016 of its Galaxy Note7 smartphones without offering an adequate replacement for consumers. According to the complaint, the phones were prone to “overheating and exploding and/or catching fire,” and Samsung urged consumers to “immediately stop using the Note7.” The devices Samsung offered to replace the recalled phone were allegedly of “lesser quality and offered less advanced technology,” and they were discontinued in October 2016. The plaintiff says she was forced to continue using her Note7 after the recall due to Samsung’s failure to provide a replacement device, and the phone overheated a month later and injured her daughter. “As a direct and proximate result of the Defendant’s negligence,” consumers were left with dangerous or unusable devices while still incurring costs from cellular carriers, the complaint says.
