International Business Machines Corporation, IBM, is the defendant in a Florida sales worker’s proposed class action claiming he and others were not paid proper time-and-a-half overtime wages. The plaintiff, who the case says has worked for IBM since 2001, claims he and other “sales transaction support” personnel were subject to the defendant’s willful policy and practice of not paying time-and-a-half hourly overtime wages for all hours worked past 40, a violation of the Fair Labor Standards Act (FLSA).
