The 22-page false advertising lawsuit alleges the maker of Ryder XL has deliberately lied about the product containing only herbal ingredients, namely to falsely suggest that men can use the supplement to achieve positive results for ED without having to consult with a physician, disclose their ED to a third party, or consume pharmaceuticals.
According to the complaint, lab testing has revealed that Ryder XL is adulterated with sildenafil, the PDE5 enzyme inhibitor found in Viagra, and tadalafil, the PDE5 inhibitor found in Cialis. PDE5 inhibitors, which block the PDE5 enzyme to relax blood vessels and increase flow, are available in the United States by prescription only, and those who take PDE5 inhibitors do so under the supervision of a doctor, the proposed class action says.
“The dangerous presence – even to healthy individuals – of doses of two controlled substances is not disclosed on the product label,” the case reads.
The supplements lawsuit charges that defendants ATA International and its CEO and CFO are well aware that Ryder XL is adulterated with sildenafil and tadalafil, and that PDE5 inhibitors are available only under doctor supervision and by prescription, yet have knowingly put the health of consumers at risk by failing to disclose the pharmaceuticals in the supplement.
“Defendants are drug dealers who have introduced misbranded drugs into interstate commerce with the intent to defraud and to mislead, all in violation of federal criminal statutes,” the lawsuit scathes.
The suit further alleges the misrepresentation of the Ryder XL ingredients is intended to dupe men suffering from medical conditions that forbid them from taking PDE5 inhibitors into thinking Ryder XL delivers the promised results with only natural ingredients. The plaintiff is a New Jersey consumer who the case says suffers from high blood pressure and high blood sugar, conditions for which he takes prescription medication and that prohibit him from ingesting sildenafil and/or tadalafil for ED.
The plaintiff claims to have experienced headache, dizziness and blurred vision after taking Ryder XL.
According to the case, the amount of tadalafil in Ryder XL is 33.8 mg, even though the medically recommended maximum dose of Cialis per day is 20 mg.
Further, the complaint says that although Ryder XL is touted as made in the USA at a GMP-certified facility, the product is in truth believed to be formulated in Malaysia.
The Ryder XL lawsuit looks to cover all United States residents who bought Ryder XL at any time in the last six years.
