Rushmore Loan Management Services Sued Over at Least 10 ‘Inaccuracies’

Rushmore Loan Management Services is facing a class action in Florida for allegedly 'systematically' producing inaccuracies in consumer reports.
A Florida woman claims in a proposed class action that defendant Rushmore Loan Management Services LLC (RLMS) has committed numerous violations of the Fair Credit Reporting Act (FCRA) with its allegedly systemic practice of producing inaccurate consumer information. The 13-page lawsuit claims the plaintiff was harmed after RLMS allegedly furnished inaccuracies about her to no fewer than two credit reporting agencies, including Trans Union and Equifax, each month for five consecutive months. The lawsuit claims RLMS has committed 10 FCRA violations throughout its relationship with the plaintiff. From the lawsuit:
“For five consecutive months beginning in January 2017 (the same month [the plaintiff’s uniform security note] was accelerated) and continuing until May 2017, [the defendant] continued to furnish inaccuracies about [the plaintiff] in relation to the [uniform security note] and mortgage to various [credit reporting agencies], including Trans Union and Equifax, which were then included in [the plaintiff’s] consumer reports. These reports show that [the defendant] engaged in the harmful practice of furnishing inaccuracies falsely asserting that [the plaintiff] has missed installment payments pursuant to the original note and mortgage to no less than two [credit reporting agencies] in violation of the FCRA and despite Wells Fargo’s acceleration in the [verified complaint to foreclose mortgage], making monthly payments no longer an option or a requirement applicable to [the plaintiff].”
