Research Triangle Institute – which does business as RTI International – is facing a proposed class action alleging violations of the Telephone Consumer Protection Act (TCPA). The suit was filed by a California resident who claims he received multiple unwanted phone calls from the defendant.
The lawsuit alleges that beginning in or around February or March 2018, the plaintiff received phone calls from the defendant in an attempt to collect information for survey research. The plaintiff claims that the calls, which were allegedly made using an automatic dialing system, were unsolicited, as he has never been a customer of the defendant nor did he give the company his phone number. Under the TCPA, consumers must give prior express consent to receive calls made using an automatic dialing system, the complaint says. The suit seeks $500 in statutory damages “for each and every violation,” as well as an order prohibiting the defendant from engaging in such conduct in the future.
