A proposed class action seeking damages for alleged FDPCA violations claims defendant RSI Enterprises, Inc. sent a collection notice containing contradictory statements.
A proposed class action seeking damages for alleged Fair Debt Collection Practices Act (FDPCA) violations claims defendant RSI Enterprises, Inc. sent a collection notice to the plaintiff that contained “multiple contradictory and confusing statements” about the amount of debt owed. More specifically, the case claims the unsophisticated consumer would be unclear as to which sum of money accurately represented the “service date balance,” adding that it could be confusing as to precisely which amount the defendant was attempting to collect since two different amounts of money were listed in the notice.
