Rothman Evans, P.C. is on the receiving end of a proposed class action lawsuit that claims the debt collector failed to include in a collection letter a disclosure regarding the plaintiff’s debt dispute rights. In particular, the letter allegedly neglected to inform the man that the defendant is only required to send him verification of the debt if he submits his dispute in writing.
The case argues that the plaintiff “could raise a dispute in many ways,” and the letter’s failure to explain the written dispute requirement could cause the plaintiff to be unsure as to how he could take advantage of his rights under the Fair Debt Collection Practices Act (FDCPA).
