Roger Naaman Insurance Services, Inc. and two entities that operate as Naaman Insurance Agency, Inc. in Texas and California are facing a proposed class action that claims the defendants sent unsolicited fax advertisements in violation of the Telephone Consumer Protection Act (TCPA). The plaintiff in the case, a Maryland business, alleges it received faxes advertising the insurance companies’ services without ever having provided prior consent to receive the messages. Even further, the suit claims the faxes lacked required opt-out language informing the recipient of how to avoid future faxes. The casea claims the sender’s failure to adhere to an opt-out request constitutes a violation of the TCPA.
