A Florida woman has filed suit against Retrieval-Masters Creditors Bureau, Inc. (which does business as RMCB Collection Agency) alleging the debt collector overshadowed her right to dispute the debt with demands for payment.

A Florida woman has filed suit against Retrieval-Masters Creditors Bureau, Inc. (which does business as RMCB Collection Agency) alleging the debt collector overshadowed her right to dispute the debt with demands for payment. The complaint claims the plaintiff received a collection letter from RMCB stating an “Amount Due” in large font and informing her that her payment “is necessary” and she should consider settling her account “now.” The letter then supposedly stated “SEE REVERSE SIDE FOR IMPORTANT INFORMATION” and included the required disclosures about the plaintiff’s right to dispute on the back of the notice. The suit argues that though the defendant included the dispute information as instructed by the Fair Debt Collection Practices Act, the disclosure was “overshadowed” by the emphasized demand for immediate payment on the front of the letter, which the complaint says could cause the least sophisticated consumer to be unsure as to his or her rights.
