A proposed class action has been filed against Richard J. Miller & Associates, P.C. claiming it sent a collection notice that failed to comply with the Fair Debt Collection Practices Act (FDCPA). According to the complaint, the defendant required in the letter that consumers submit disputes in writing. The suit argues that this language oversteps the FDCPA, which it says does not demand written disputes, and unlawfully misleads the unsophisticated consumer.
