RGS Financial, Inc. is facing a proposed class action lawsuit filed by a New York man who claims the debt collector unlawfully failed to communicate.
RGS Financial, Inc. is facing a proposed class action lawsuit filed by a New York man who claims the debt collector unlawfully failed to communicate in a collection letter the amount of his alleged debt and his right to dispute the debt. The letter supposedly contained an “amount owed” but did not indicate whether the amount was static or whether it would increase due to interest and fees. On top of that, the suit claims the letter “overshadowed” the consumer’s right to dispute the alleged debt by including the disclosure on the back of the letter and failing to mention it in the list of “options” on the front of the letter. The placement of this important information would mislead the unsophisticated consumer and cause confusion, the complaint argues.
