RGS Financial, Inc. is facing a class action over its allegedly deceptive debt collection practices. Filed in New York, the lawsuit claims RGS left proposed class members phone messages without clearly disclosing that the calls were from a debt collector. Failure to disclose the nature of the communication—that the calls were made by debt collectors attempting to collect debts—is a violation of the Fair Debt Collection Practices Act (FDCPA), as the unsophisticated consumer could mistakenly believe the calls were from the original creditor.
