Retrieval-Masters Creditors Bureau, Inc., which does business as American Medical Collection Agency, is on the receiving end of a proposed class action alleging it illegally profited and collected millions of dollars from Florida consumers in violation of the Fair Debt Collection Practices Act (FDCPA). The plaintiff claims the defendant unlawfully imposes through its online payment portal an explicitly prohibited $4.95 convenience fee for “the privilege of making a payment using a credit card or debit card.” According to the case, the defendant’s online convenience charge is a direct violation of the FDCPA because the company has no express contractual right nor express statutory right to assess such a fee.
