A proposed class action filed last week in California by Retina Associates Medical Group, Inc. seeks to end defendant VisionWeb Holdings, L.L.C.’s alleged practice of sending unsolicited junk fax advertisements that do not contain mandatory opt-out notices. The lawsuit claims the defendant’s alleged junk fax ad campaign was “not sporadic or unorganized, but instead part of a well-organized mass advertising tactic” executed with disregard for the federal Telephone Consumer Protection Act (TCPA).
