The 12-page case alleges that the RNC has launched an “intrusive” automated text messaging campaign to promote its political agenda in violation of the Telephone Consumer Protection Act (TCPA), a federal law that prohibits the use of an artificial or prerecorded voice to deliver text messages to consumers for non-emergency purposes without consent.
According to the suit, the plaintiff received an unsolicited text message from the RNC on October 24, 2020 despite having no relationship with the organization and never consenting to be contacted. The message contained a video file that automatically downloaded to the plaintiff’s phone and contained an artificial or prerecorded voice, the complaint says.
Per the case, the text message spam is sent out “en masse without variation” and regardless of whether the RNC has obtained permission to contact the recipient.
“Defendant’s unsolicited text caused [the plaintiff] actual harm, including invasion of his privacy, aggravation, annoyance, intrusion on seclusion, trespass, and conversion,” the filing reads. “Defendant’s text message also inconvenienced [the plaintiff] and caused disruption to his daily life.”
The lawsuit looks to represent anyone in the United States who, within the past four years, was sent a text message from the Republican National Committee or anyone on its behalf to their cellular telephone number or residential line that included an artificial or prerecorded voice in a video without their prior express consent.
